Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you and CaskCoded s.r.o. ("we", "us", "Lorn.ai") governing your access to and use of the Lorn.ai platform at lornai.caskcoded.com ("Service"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Service Description

Lorn.ai is an AI-powered recruitment screening platform that enables:

  • Candidates to complete automated AI voice screening simulations for job positions
  • HR professionals and organizations to receive structured, AI-generated evaluation reports
  • Recruiting agencies to deploy white-label screening workflows
  • Organizations to manage job postings, candidate pipelines, and team members

The Service uses voice AI (ElevenLabs) and language model analysis (OpenAI) to conduct and evaluate screening conversations. AI-generated evaluations are advisory in nature and are not binding hiring decisions.

2. Eligibility and Account Registration

To use the Service, you must be at least 16 years of age and have the legal capacity to enter into a binding agreement. By registering, you represent that all information you provide is accurate, current, and complete.

You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activity that occurs under your account
  • Notifying us immediately at studio@caskcoded.com if you suspect unauthorized access
  • Keeping your account information up to date

Each account is for individual use only. Organizations may create organization accounts with multiple members, each with their own credentials.

3. Candidate Terms

3.1 Consent to AI Screening

By initiating a screening session, you explicitly consent to your voice being recorded and your responses being processed by AI systems (ElevenLabs and OpenAI) to generate evaluation scores and reports. You may withdraw consent at any time by not proceeding with a session, but completed sessions cannot be retroactively deleted by you within the active review period.

3.2 Accuracy of Information

You agree to provide truthful information during registration, profile setup, and screening sessions. Misrepresentation of qualifications, experience, or identity may result in immediate account termination and disqualification from any associated job positions.

3.3 Screening Results

AI-generated evaluation scores and reports reflect algorithmic assessments based on your screening conversation. These scores are provided to HR organizations as advisory inputs. Lorn.ai is not responsible for hiring decisions made by organizations based on screening results.

4. HR Organization Terms

4.1 Data Processing Agreement

When using Lorn.ai to screen candidates, your organization acts as a data controller in respect of candidate data you collect and review. By accepting these Terms, you also accept our Data Processing Agreement (DPA), incorporated herein by reference, which governs the processing of candidate personal data on your behalf.

4.2 GDPR Compliance Obligations

If your organization operates within the EU/EEA or screens EU/EEA residents, you are responsible for:

  • Informing candidates that an AI screening platform is used in your recruitment process
  • Obtaining any additional consents required under your applicable law
  • Ensuring a lawful basis exists for processing candidate data
  • Responding to candidate data subject rights requests within statutory deadlines
  • Not using screening results as the sole basis for automated hiring decisions without human review (GDPR Art. 22)

4.3 Job Postings and Invite Tokens

You are responsible for ensuring that job postings on the platform are accurate, non-discriminatory, and compliant with applicable employment law. Private job invite tokens must not be shared publicly.

5. Prohibited Uses

You agree not to:

  • Use the Service for any illegal purpose or in violation of applicable law
  • Attempt to gain unauthorized access to any part of the Service or other users' accounts
  • Reverse engineer, decompile, or attempt to extract the source code of the platform
  • Use the Service to discriminate against candidates based on protected characteristics
  • Impersonate another person or entity during screenings or account registration
  • Scrape, harvest, or extract data from the platform using automated means
  • Interfere with or disrupt the integrity or performance of the Service
  • Use the Service to develop a competing product or service
  • Transmit any malware, viruses, or harmful code
  • Share your account credentials with unauthorized third parties

6. Intellectual Property

All intellectual property rights in the Service, including its design, code, AI models, interfaces, and content created by Lorn.ai, are owned by or licensed to CaskCoded s.r.o. These Terms do not grant you any rights to use our trademarks, logos, or brand elements.

You retain ownership of content you upload (e.g., CV documents, job descriptions). By uploading content, you grant us a limited, non-exclusive license to process it solely for the purpose of providing the Service.

AI-generated evaluation reports produced using your data are provided to you under a limited license for internal recruitment purposes only.

7. Service Availability and Modifications

We strive to maintain high availability but do not guarantee uninterrupted access. We reserve the right to:

  • Modify, update, or discontinue any part of the Service with reasonable notice
  • Perform maintenance that may temporarily affect availability
  • Change pricing or subscription terms with at least 30 days advance notice

8. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Service is provided "as is" without warranties of any kind, express or implied
  • We do not warrant that AI evaluations are accurate, complete, or suitable for any particular purpose
  • We are not liable for any hiring decisions made based on Lorn.ai evaluation reports
  • Our total liability for any claim arising from use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim
  • We are not liable for indirect, incidental, consequential, or punitive damages

Nothing in these Terms excludes liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded by law.

9. Termination

Either party may terminate the agreement at any time. You may delete your account from your profile settings. We may suspend or terminate your access immediately if:

  • You breach any provision of these Terms
  • Your use of the Service causes harm to others or to the platform
  • We are required to do so by law or court order

Upon termination, your right to use the Service ceases immediately. Data deletion follows our retention policy as described in the Privacy Policy.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Slovak Republic, without regard to conflict of law principles. Any disputes shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to the exclusive jurisdiction of the competent courts of the Slovak Republic.

EU consumers may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

11. Changes to Terms

We may update these Terms from time to time. For material changes, we will notify you by email at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
